On August 28, 2025, the Board of Governors approved (not unanimously) the government mandated Interim Fairness in Sports Policy, effective September 1, 2025, until October 10, 2025 (when the Board of Governors will next be able to discuss this matter).
This Policy is mandated to be in effect on September 1, 2025, through the Government of Alberta’s Fairness and Safety in Sport Act and its Regulations. While the Board of Governors recognizes that the Post-Secondary Learning Act requires that universities are compliant with all provincial legislation, the Board is committed to ensuring that there is proper consultation in advance of considering a final policy and that the perspectives of our University community are heard and shared with the Ministers (Advanced Education, and Tourism and Sport) and the Premier.
We thank those who shared their thoughtful responses on this legislated Policy during the initial consultation period. Some limited amendments were made to the draft interim policy based on that feedback. These are outlined below and are embedded in the Draft Policy currently under review.
The consultation period has now reopened, in advance of the Board considering the final policy approval in October. Please review the Draft Fairness in Sports Policy, and for context, the provincial Act and its regulations, as well as the Model Policy and the FAQs provided by the Government of Alberta provided by the Government of Alberta. All feedback from the initial consultation period remains under consideration, but we also invite further review and feedback of the Draft Policy (Fairness in Sports Policy). Further feedback should be directed to governance@uleth.ca by September 17, 2025.

Six Amendments Made Based on Policy Feedback:
Section 1: Added a clause to rescind the policy immediately if the legislation is repealed
1.1. This Policy has been mandated by the Government of Alberta's Fairness and Safety in Sport Act and Regulation. Should the governing legislation be repealed, this policy will immediately be rescinded.
Section 4.10 added “Principles of Procedural Fairness and Natural Justice” using the Government of Canada’s definition.
4.10. “Principles of Procedural Fairness and Natural Justice” means the opportunity to be heard by an unbiased decision maker, and to be given enough information about the Challenge and the decision being made to participate meaningfully.
Section 5.2: Wording updated to “affected and/or harmed.”
5.2. The University commits to providing to members affected and/or harmed by the required implementation of this Policy access to available University supports and resources, including 2SLGBTQ+ Resources and Counselling services.
Section 8.2.1.3:
8.2.1.3. The right to confidentiality during the Challenge process, except where disclosure is required by law, pursuant to section 10.
8.3 and 8.4.2 – Right to Appeal Clarity (two instances)
8.3. Right to appeal the decision to dismiss, or proceed with the Challenge , or a determination of ineligibility.
8.4.2. A decision on Athlete eligibility will be issued to both the Applicant and the Affected Athlete and shall be final, subject to the right to appeal pursuant to 8.3.
Section 9: inclusion of sanctions if there is a breach of confidentiality.
9.2. Where a Challenge is found to be made in Bad Faith or where there is a breach of confidentiality during the Challenge process, the Executive Director, Athletics and Recreation Services, will impose reasonable penalties on the Applicant, including but not limited to:
